Privacy policy for applicants

With this privacy policy, we inform you (hereinafter “Applicant”) about the nature, scope and purpose of the personal data processed by PACE Paparazzi Catering & Event GmbH (hereinafter also “we” or “us”) and your rights as a data subject in the context of the applicant search.

1. Responsible

Responsible for data processing according to Art. 4 No. 7 DSGVO is, unless otherwise stated in this privacy policy, PACE Paparazzi Catering & Event GmbH, Axel-Sprin-ger-Str. 65 in 10888 Berlin, +49 30 2591 74828, karriere@pace.berlin.
Insofar as we engage a service provider for the placement of suitable candidates to fill positions advertised by us (hereinafter referred to as CONTRACTOR), it is important to note that CONTRACTOR itself is responsible for the legality of the transfer and will inform the candidates in accordance with applicable law (in particular Art. 13, Art. 14 DSGVO) within the scope of its privacy policy (available at the following link).

 

2. personal data

2.1 Nature of the data processed
In the course of the applicant search, the following personal data of the applicant in particular is collected and processed:

  • Personal data (name, address, date of birth, place of birth and nationality) and other (specified) contact data,
  • Information about qualifications (e.g. certificates, evaluations, training certificates, information about skills and talents from career portals),
  • Work experience, work history (e.g., previous employers, current position with employer, nature of duties and responsibilities, length of employment).

2.2 Origin of the data
We only process data of the applicant which has been made public by him/herself or which can be viewed via publicly accessible sources or which the applicant communicates to CONTRACTOR for the purpose of placement, e.g. personal data

  • auf Webseiten (z. B. Portfolios, Arbeitsproben, Bewerbungsseiten),
  • on relevant career networks (e.g. Xing or LinkedIn profiles),
  • in articles or publications in digital or print media.

 

3. Purpose as well as legal basis of the processing

Die personenbezogenen Daten des Bewerbers werden im Einklang mit der Datenschutz-Grundver-ordnung (DSGVO) und dem Bundesdatenschutzgesetz (BDSG) verarbeitet. In addition, the personal data of the applicant that CONTRACTOR transmits is collected and processed exclusively for recruitment processes, insofar as this is necessary for the decision on or for the establishment of an employment contract with the applicant.
The following legal bases of processing are applied:

3.1 Legitimate interest, Art. 6 para. 1 lit. f DSGVO
We process the applicant’s data to the extent necessary to protect our legitimate interest in enabling and properly carrying out the selection of suitable applicants and their examination for filling advertised positions. Our legitimate interest exists in particular if the personal data is made public on the Internet and is not protected by separate privacy settings or if the applicant indicates that he or she wishes to receive job offers by making the appropriate settings on relevant professionally oriented networks.

3.2 Consent, Art. 6 para. 1 lit. a DSGVO
We may also process the applicant’s personal data as part of the applicant search process, provided that the applicant has given CONTRACTOR consent to disclose the data to us. Consent given can be revoked at any time. It should be noted that the revocation is only effective for the future. Processing that took place before the revocation is not affected.

 

4. Data sharing

We will only transfer the applicant’s personal data received from CONTRACTOR to third parties if the transfer is necessary to enable and properly carry out the selection of suitable applicants to fill advertised positions, if we are otherwise legally entitled or obligated to transfer the data, or if the applicant has given us the appropriate consent. We will inform the applicant in advance who the recipients of the data are.
In order to provide our service, selected personal data may be communicated to certain departments within our company. This includes employees who are responsible for finding applicants.

 

5. Social Media Plugins

No social media plugins are integrated on this website that directly load data from the servers of the respective social media providers. The integrated “plugins” are simple links to the respective third-party sites, which we illustrate with corresponding graphics. A transmission of personal data to the operator of the social media service by the known plugins therefore does not take place.

 

 

6. Data transfer to third countries

Data transfer to third countries (countries outside the European Economic Area – EEA) only takes place with the consent of the applicant or if the standard contractual clauses have been concluded.

 

7. Storage duration

We process personal data only as long as this is necessary for the respective application process in the context of which CUSTOMERS have contacted the applicant. Mit dem Ende des Bewerbungsverfahrens (Besetzung der ausgeschriebenen Stelle / unter-schriebener Arbeitsvertrag) werden anschließend die personenbezogenen Daten des Bewerbers von uns gelöscht, sofern einer Datenlöschung keine gesetzlichen Aufbewahrungspflichten entge-genstehen bzw. der Bewerber nicht darin eingewilligt hat, dass seine Daten weiterhin für möglicher-weise zukünftige Stellenausschreibungen gespeichert werden (sog. Einwilligung in die Aufnahme in das Talentpool).

8.1 Auskunft und Berichtigung
The applicant can obtain information from us at any time and free of charge as to whether personal data relating to him or her is being processed by us and also specifically what data is being stored about him or her, as well as request a copy of the stored data. The applicant may also have incorrect data corrected and completed.

8.2 Deletion
The applicant may request the deletion and restriction of his/ her personal data.

8.3 Data portability
Where applicable, the applicant also has the right to have personal data concerning him or her transferred to him or her or to another controller in a structured, commonly used and machine-readable format, provided that the processing is based on consent or on a contract and is carried out using automated means. However, this does not apply if the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority which was transferred to the person responsible. Furthermore, the applicant has the right to obtain that the personal data be transferred directly from one responsable person to another responsable person, insofar as this is technically feasible and insofar as this does not adversely affect the rights and freedoms of other persons.

8.4 Automatisierte Entscheidungsfindungen
Wir nutzen keine automatisierten Verarbeitungsprozesse zur Herbeiführung der Entscheidung, wel-cher der Bewerber dem Arbeitgeber bezüglich des ausgeschriebenen Stellenangebots vorgeschla-gen wird. Automatisierte Entscheidungsfindungen i. S. d. Art. 22 DSGVO finden bei uns im Rahmen der Bewerbersuche somit nicht statt.

8.5 Information and right of objection
The consent(s) given by the applicant may be revoked at any time with effect for the future by sending an e-mail to the above-mentioned contact address. Furthermore, the applicant has the right to object at any time, on grounds relating to his/her particular situation, to the processing of personal data relating to him/her which is carried out on the basis of a legitimate interest. We will no longer process personal data in the event of an objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the applicant, or the processing serves to assert, exercise or defend legal claims.

8.6 Right of appeal
